During the February 20, 2019, ministerial council, Mali passed a draft decree setting the requirements governing the issuance of licenses to encryption service providers.
The draft decree was passed based on the report of the minister of communications and digital economy and it establishes the files to be provided by these providers as well as their contractual duties and the sanctions they will be subjected to in case of a breach.
The draft decree comes to complement the judicial encryption framework established since 2016 via the law n° 2016-011/ of May 6, 2016, on rules applicable to the mediums, conditions and delivery of encryption services in Mali. This text entrusts the regulation of those activities to the telecom regulator.
